What to know about Colorado contract disputes

  • The contract controls a lot. Most Colorado home sales use the Real Estate Commission’s standard Contract to Buy and Sell, which sets deadlines, notice rules, and what happens to earnest money. The standard contract also includes a mediation provision, so check it before filing suit.

  • Brokers need written agreements. Since August 12, 2026, a Colorado broker must have a written agreement that clearly discloses compensation before doing brokerage work for a client (C.R.S. 12-10-403(2), as amended by HB26-1426).

  • Deadlines apply. Most contract claims in Colorado must be brought within three years (C.R.S. 13-80-101), generally counted from when the breach was discovered or should have been discovered (C.R.S. 13-80-108).
