What to know about Colorado HOA law
Most Colorado HOAs are governed by CCIOA. The Colorado Common Interest Ownership Act (C.R.S. 38-33.3) sets many of the ground rules, alongside each community’s declaration, bylaws, and rules.
Fines require a fair process. Associations must adopt a written policy on enforcing covenants and rules, including notice and hearing procedures. Before a fine, an owner must get notice and an opportunity to be heard before an impartial decision maker (C.R.S. 38-33.3-209.5).
Owners can inspect association records. With a written request describing the records with reasonable particularity, submitted at least ten days before inspection, owners can review many association records, including financial statements, minutes, and contracts (C.R.S. 38-33.3-317).
